Here's something that catches a lot of out-of-state buyers and sellers off guard: real estate in New Mexico doesn't work the way it does in most other states. If you're coming in assuming your broker works exclusively for you, you need to know this before you get to the table.
How It Works in Most States
In most places, your real estate broker is your agent. Think of it like having your own attorney. They work exclusively for you, they're loyal to you only, and their job is to fight for your interests and nobody else's.
New Mexico Is Different
New Mexico practices something called transaction brokerage. Your broker isn't exclusively in your corner. They're a neutral professional who helps both the buyer and the seller get through the deal honestly and fairly. Both sides are owed honesty, good faith, and reasonable care, but the broker isn't exclusively loyal to either one.
Here's the Upside
Because the broker isn't locked into one side, a single broker can legally and ethically represent both the buyer and the seller in the same transaction with no conflict of interest. In an agency state, that could raise some serious problems. In New Mexico, it's just how it works.
